About these terms

These terms are the agreement between you and the operator of SetMatcher, named under Who we are. They apply when you make an account and whenever you use SetMatcher. By making an account you accept them.

How we handle your personal data is described in the privacy policy.

Who we are

SetMatcher is run by the operator named below. Write to the contact address about anything in these terms.

Your account

• You must be 16 or older, or have the permission of a parent or guardian.
• Use your own name and an email address that is yours.
• One account per person. Do not share it, or your password.
• You are responsible for what is done with your account. If you think somebody else is using it, change your password and tell us.
• Most of SetMatcher is free and stays free: playing, recording matches, ratings, groups and a club’s register. Some things are paid for, and they are set out under What costs money. You are always shown the price and asked before anything is charged.

Results and ratings

• Enter results as they happened. A result you enter changes your opponent's rating as well as yours.
• A rating is an estimate of level worked out from results. We do our best to make it fair, but it is not the official ranking of any federation, and we do not guarantee it.
• Administrators may correct or remove a result that is wrong, and recalculate ratings, where that is needed to keep them fair.

Groups and tournaments

• A group is run by its organiser, who decides who joins, can remove members, and runs its tournaments.
• Matches are played between players, on courts they arrange. SetMatcher does not organise the matches themselves, and is not responsible for courts, bookings, equipment or what happens on court.
• Play safely, and follow the rules of the sport and of the venue.

What is not allowed

• Entering results that did not happen, or scores you know are wrong.
• Harassing, threatening or insulting other players, in messages or anywhere else.
• Pretending to be somebody else, or making an account for somebody who did not ask for one.
• Adding anything illegal, or anything that infringes somebody else's rights.
• Advertising or spam.
• Trying to get into accounts or parts of SetMatcher that are not yours, overloading it, or collecting other players' data with automated tools.

What you add

The names of groups and tournaments, messages, photos and reports you add remain yours. You allow us to keep them and show them to the people they are meant for, for as long as they are in SetMatcher. Do not add anything you have no right to share.

How we moderate

Moderation is done by people: SetMatcher's administrators. No automated system removes content or accounts.

When something breaks these terms, an administrator may, depending on how serious it is, correct or remove a result; remove a group or tournament from view, where nothing is deleted and it can be restored; remove a member from a group, or hand a group to another organiser; or suspend an account, which signs it out and keeps it out until the suspension is lifted.

When a group or tournament is removed, its organiser is told the reason. If your account is suspended, or something else was decided about you, you can ask us why at the contact address, and we will tell you.

If you disagree with a decision, tell us through Report a problem or at the contact address. We look at it again and tell you the outcome.

What costs money

Playing, recording a match, ratings, groups of any size, a club’s register of any size, and every tournament, league, ladder and competition up to the free size with every tool it has, cost nothing at all. Four things are paid for.

• SetMatcher Plus, for one person: their own events at any size in the groups they run themselves, and the statistics worked out from matches scored point by point.
• An event pass, for one tournament: that tournament at any size, with the whole event day. It belongs to the event and does not expire.
• SetMatcher Club, for a club: every event the club owns at any size, with the whole event day, for everybody on its committee, and the club’s pages on its own website.
• Paid entry, where an organiser collects an entry fee through SetMatcher: the fee is theirs, and we take a share of each paid entry as our fee for handling it.

Prices are in euro, include VAT, and are shown before you pay. A subscription renews at the end of each period until you cancel it. Nothing you have made or recorded is removed because a plan ended; what stops is going past the free size again.

Entry fees: who you are buying from

Where a tournament collects entry fees through SetMatcher, the organiser sells the entry and we do not. We handle the payment for them and in their name: it is charged straight into their own account with our payment provider, the checkout and the receipt name them, and it is their money from the moment it lands. Our only part is the platform fee we charge them for handling it.

So the agreement about the entry is between you and the organiser: what you get for it, what happens if the event is moved or called off, and who decides once entries have closed. We name them before you pay and again on the payment page, and we carry out the refunds set out under Cancelling, changing your mind and refunds.

An organiser can only collect entry fees through SetMatcher if they are established in a country we have opened for it. Which countries those are is shown before they start, and the list grows as each country is settled. Recording who has paid by hand, with no money moving through SetMatcher, is free for everybody and open everywhere.

Cancelling, changing your mind and refunds

You can cancel a subscription yourself at any time. It keeps running until the end of the period you have already paid for, and stops there.

As a consumer in the European Union you have fourteen days to withdraw from a subscription. At checkout you are asked to agree that it begins at once, which under the law can end that right; we do not rely on that. Within fourteen days of a subscription’s first payment we refund it in full on request, whatever was agreed.

An event pass is refunded in full on request until the first result of that tournament is recorded. After that it has been used.

Where a tournament collects entry fees through SetMatcher, the fee is the organiser’s and the entry is an agreement with them. Withdrawing before entries close is refunded in full, our fee included; after entries close the organiser decides, and our fee is not returned.

If a payment fails, everything stays as it is for fourteen days and we write to you while that runs. After it, the plan becomes the free one again. Nothing is deleted because a payment stopped, and a later payment restores what was held.

The service

SetMatcher is provided as it is. We work to keep it available and correct, but we cannot promise that it will always be available, free of errors or unchanged. We may change or stop features. If we plan to stop SetMatcher altogether, we tell you in good time, so you can ask for a copy of your data.

Liability

We are not liable for damage arising from using SetMatcher, from matches you play through it, or from what other players do, except where the law does not allow that to be excluded (for example for intent or gross negligence) or where the mandatory consumer law of the country you live in gives you more protection.

Ending

You can stop using SetMatcher at any time. You can delete your account yourself under Settings, Privacy; it is deleted 30 days after you ask. An account nobody signs in to for three years is deleted too: we email you 30 days before, and signing in keeps it.

We may suspend or end an account that seriously or repeatedly breaks these terms.

Changes to these terms

These terms have a version and a date, shown at the top. If we change them in a way that matters to you, we tell you in the app beforehand and ask you to accept the new version before you carry on. If you do not accept it, you can stop using SetMatcher.

Law and disputes

Dutch law applies to these terms. A dispute goes to the competent court in the Netherlands, unless the law of the country you live in as a consumer lets you take it to a court there; you keep that right.
